When I used a Treo 650 (Palm OS) a short time ago, I used an app called CallRec. It automatically recorded every call
incoming and outgoing, and every voicemail taken on the phone, as well as serving as a general voice recorder.
The sound quality was excellent and it recorded in a format that was transportable.
It did not emit a warning tone during recording.

Yup, that's Palm. Unfortunately, the other Smartphone OS'es (except for
Symbian) are different: very few WinMo handsets support call recording and
absolutely none BlackBerries.

In many States, it is against the law to record telephone conversations
unless both parties have agreed that it okay, and the beep is recorded with
the conversation.

However, the law is aimed at the person electing to illegally taping a
call and, the issue here is not the law, but the oem's decision to
pre-enforce the law with no regard to the many other legitimate reasons
where users need and benefit from recording calls.
....for example, when receiving directions from the person on the other
end of the call.

Yes, I know. However, th e number of these U.S. states is about 11 - the
rest allows for call recording without even the other side knowing about
this. Please see my related articles, where I even linked to the pages
listing these states.
All in all, both WM hardware manufacturers and BlackBerry should allow for
call recording.

Agreed. Crippling phones the way RIM (BlackBerry) and most Windows Mobile
handset manufacturers (except for GigaByte) do is really-really a bad move.
